Delhi court orders perjury probe against woman who accused BJP leader of rape

Accordingly, the impugned order is set aside with the direction to the Ld. Trial Court to hold an inquiry and proceed as per law,” said Special Judge Jitendra Singh in his February 20 order.In April 2018, the woman had alleged that Hussain took her to a farmhouse and raped her after intoxicating her. He, according to the complainant, also made a video of the act and threatened to kill her and her family.Earlier, the police had filed a cancellation report in favour of Hussain, saying their probe found “no prima facie offence” against Hussain. A delay of four to five years in lodging of FIR was cited as one of the reasons for cancellation. The woman filed a protest petition against the cancellation.“An allegation of sexual impropriety can permanently stain an individual’s reputation, even when a determination ultimately occurs that the accuser accidentally or deliberately made a false accusation,” noted the judge. “…the fact that prosecutrix has filed the protest petition against the cancellation report in spite of the fact that the presence of A-2 (Hussain) and prosecutrix on the date and place of alleged incident has been completely ruled out by scientific and documentary evidence, points to a sustained effort on behalf of prosecutrix to falsely implicate A-2,” he said. The revision petition filed by the woman was set aside by a Delhi court and the cancellation report was accepted via an order dated December 16, 2023.
