Amanatullah and his supporters have been booked under sections 221 (obstruction of public servants while they are performing their duties), 132 (criminal force or assault against a public servant while they are performing their duties), among others, of the BNS (Express Archives)“What were you doing with a man, who had secured an anticipatory bail, for 20 minutes?”: The question was posed by a court to the Delhi Police Monday amid a hearing linked to a case in which AAP Okhla MLA Amanatullah Khan has been booked.Special Judge Jitendra Singh of Rouse Avenue Court, who was hearing the case, reserved the order on the anticipatory bail plea of the AAP MLA, booked over an alleged attack on a police team, for Tuesday. Khan has been accused of obstructing police personnel from arresting Shahwez Khan, an alleged proclaimed offender.“Shahwez Khan has secured anticipatory bail. The supplementary chargesheet has not been filed against him. This is the admitted position…what were the police officers doing with him inside a shop for 20 minutes?” Judge Singh asked Monday.While extending protection from arrest to the AAP leader by a day, Judge Singh also asked the Delhi Police to show CCTV footage of Shahwez going inside the shop where the Okhla MLA allegedly obstructed his arrest. “I’ll watch the CCTV footage… let’s keep it for orders tomorrow,” he said.While police registered an FIR against Amanatullah, Judge Singh had granted him interim protection from arrest on February 14 till February 24. At the time, Judge Singh had also questioned the police’s attempt to arrest Shahwez despite the anticipatory bail.On Monday, both sides continued to argue the matter. Senior Public Prosecutor (SPP) Atul Srivastava said, “Even if he had anticipatory bail, does it give him the right to interfere in the functioning of the police?”Advocate Rajat Bharadwaj, representing the AAP MLA, said, “Look at the status report filed by the police… they forgot to ‘inadvertently’ remove the name of Shahwez from the proclaimed offender’s list. They’re admitting their own mistake. Could it be possible that Shahwez didn’t show his bail order when police allegedly came to speak to him?”Story continues below this adSeeking the AAP MLA’s custody on behalf of the Delhi Police, SPP Srivastava said, “We need to question Amanatullah… we need his custody. He was in that area… he is lying about not being there.
