No long and unwieldy constitutional amendment is necessary.”A lot of conservative voices did not read the opinion that way, including Governor Ron DeSantis, a Harvard Law graduate, not exactly a slouch in this department. He says it’s a substantive decision that says the 14th Amendment requires citizenship for those born to, among others, birth tourists or those unlawfully present in the country.We’ll need either a constitutional amendment or a future court to overrule this. Senator Mike Lee joined in with that as well, saying it’s going to be a long fight requiring a constitutional amendment.You served in Congress as a constitutional attorney and scholar. What do you say about how this gets done if there’s a change to be made?Mike Johnson:Well, I used to litigate constitutional law cases, so I really enjoyed Justice Clarence Thomas’s dissent. Everybody should read that—it’s a must-read.He explained that the 14th Amendment’s original intent was to enhance and really value citizenship, and it’s been devalued because of birthright tourism, which is what we have now. It’s a threat to the rule of law and national security.We do need to address it. We’re looking at all angles. If there’s some legislative fix, we’ll advance that immediately. If it’s a constitutional amendment, as you know, it takes a little more time. But we’ve got to address this. He called the decision “too bad for our Country” but immediately pointed to the solution: Congress must act.The DOJ under Acting Attorney General Todd Blanche is already moving aggressively post-ruling, prioritizing prosecutions of birth tourism visa fraud schemes involving money laundering, identity theft, and wire fraud. As we reported, the administration is not surrendering, it is using every tool in the criminal code to go after the fraudsters exploiting the loophole the Supreme Court just protected.Birthright citizenship as currently interpreted incentivizes illegal immigration, rewards law-breaking, devalues American citizenship, and costs taxpayers billions in services for children and families who should never have been granted automatic membership in our country.The 14th Amendment was ratified to guarantee citizenship to the children of freed slaves, people who were “subject to the jurisdiction” of the United States in the full political sense.
