Why to Be Against Slavery Reparations By Rolf LindgrenSlavery reparations are meant to cause division in society and put people on guilt trips. They accuse people, living and dead, of crimes they were never convicted of. But that doesn’t stop the United Nations.On Monday, August 31, the UN Committee on the Elimination of Racial Discrimination said:“countries are legally obliged to consider reparations for the transatlantic slave trade” (per a Reuters news article)The UN document says:“States parties must implement comprehensive reparatory measures for people of African descent, covering all aspects of remedies”Most astonishing, the UN Committee said:“the obligations arose from a legally binding 1965 convention on racial discrimination, not from the legal standards that existed when the slave trade took place.” (Reuters summary)And…“regardless of whether slavery and the slave trade were illegal under the laws of the day, countries remain responsible under current international obligations to tackle their continuing effects.” (Text of committee report)YIKES!!!!!While it’s a noble cause to oppose slavery and racial discrimination, it’s also a noble cause to oppose slavery reparations. Here’s why.LEGALArticle 1, Section 9, Clause 3 of the US Constitution states:“No Bill of Attainder or ex post facto law shall be passed.”The ex post facto provision directly contradicts the UN. You can’t be held accountable for a retroactive crime in America.The government can’t declare you (or a group) guilty of a crime via legislation per the Bill of Attainder provision. You must be given a fair trial to be convicted of a crime, or plead guilty in open court.You also can’t be convicted of a crime that someone else or a relative committed. If one of your ancestors committed a slave crime, they committed the crime, not you.Article 1 of the 14th Amendment (ratified in 1868) says in part:“No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”In other words, white and black people must be treated equally under the law.MORALIn the Ten Commandments, Deuteronomy 5:9 states:“You shall not bow down to them or worship them; for I, the Lord your God, am a jealous God, punishing the children for the sin of the parents to the third and fourth generation of those who hate me”.This verse is a softer version of the attainder clause in our Constitution. The verse permits attainder crime accusations up to four generations: your great-grandparents, your grandparents, your parents, and you. But it prohibits crime accusation based upon your great-great grandparents.[Please note that in ancient times, attainder crimes were common, and the Bible actually limits their use. The US Constitution eliminated them.]If the average generation is 25 years, a typical person would have a great-great grandparent born about 100 years before you. For most people, that’s after 1847, the latest possible year a slave-holding adult could have been born.Not very many people today are going to be eligible for slavery reparations guilt under this Biblical verse.OTHER REASONSHere are some other problems in determining the justice of slavery reparations.* The average black American is about 18% of white heritage, per DNA analysis. Many black people have slaveowner ancestry. How does this fit into the slave reparation equation? An example is the great Frederick Douglass, whose father was a slaveowner. Would Douglass’s descendants be criminals or victims based on slave reparation logic?* What about the two million soldiers from the North who fought in the Civil War? They freed four million slaves. 360,000 northern soldiers died and another 280,000 were wounded. Are their descendants guilty of slavery reparation crimes? Or heroes?* What about people who inherited slaves and then freed them? What about people who ran the underground railroad?* What about abolitionists like John Brown? Or William Lloyd Garrison, who founded the Liberator newspaper in 1831? How are their descendants treated by the slave reparations advocates?* About 100 million immigrants have come to America since the Civil War. How could their descendants be guilty of slavery crimes?* Many black Americans have immigrated to America since the 1960s. Would they be eligible for slavery reparations?* Are the descendants of illegal aliens from Central and South America guilty of slavery crimes?* How far back in time do we have to go to hunt down slave crimes? Shall we go back to the Arab slave traders of the Middle Ages? Back to the ancient Romans and Greeks? To the ancient Chinese and Egyptians?Shall we go back to when the Homo sapiens enslaved and killed off the Neanderthals?* What about record-keeping problems? How many of us can’t document our ancestry back to the Civil War?* What about adoptions?Implementing slavery reparations would be a big fat mess. Pointing fingers at alleged victims or criminals is hopelessly complicated. Slavery reparations are wrong.
