Court of Appeal/ Courtesy photoHousing Finance Bank has appealed against a High Court ruling that found the sale of a mortgaged Najjera property unlawful, negligent and at a gross undervalue. The bank, through M/S Nangwala, Rezida & Co. Advocates, filed the appeal on June 10, 2026, saying it was “dissatisfied with the decision of  Hon. Lady Justice Susasn Odongo in Civil Suit No 0021 of 2019 given at the High Court of Uganda at Kampala on May 31, 2026” and intended to appeal to the Court of Appeal against the whole decision. In May, Justice Susan Odongo ruled in favour of Barnabas Samuel Aliku and Christine Mutesi Aliku, who had accused the bank of fraudulent and unlawful conduct and breach of contract. The couple said the bank sold their Najjera property, Kyadondo Block 219 Plot 1138, at UGX 135 million, lower than UGX 235 million a buyer was willing to offer, a significant difference of Shs100m.Housing Finance Bank had argued the couple defaulted on a UGX 119 million loan secured in 2009.A key issue in the appeal is the finding that the property was sold at an undervalue, with Housing Finance Bank challenging the basis of this finding, pointing to an alleged offer that was relied upon despite the witness being unable, during cross-examination, to identify who made the offer, when it was made, or provide documentation confirming it.According to the notice of appeal, Housing Finance Bank is asking the Court of Appeal to review the ruling on the alleged undervaluing of the property in question and other aspects of the judgment. The Appellate Court will now determine the ultimate winner of this case. The post Housing Finance Bank Appeals Najjera Property Ruling After Court Says It Sold UGX235m House for UGX135m appeared first on Business Focus.
