Every week, the TDN posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA) related rulings from around the country.The following rulings were reported on HISA's “rulings” portal and through the Horseracing Integrity and Welfare Unit's (HIWU) “pending” and “resolved” cases portals.Among this week's rulings, trainer Arturo Chavez has been banned two years and fined $25,000 for an out-of-competition medication violation after his trainee, She Mysterious, tested positive for the presence of non-inhalation Albuterol (Salbutamol) in a sample taken Dec. 9 last year.Albuterol, a bronchodilator, is banned when injected and permitted for use only as an inhaled drug, as long as it's prescribed by a veterinarian as part of a valid veterinarian-patient-client relationship and recorded in the HISA portal. Read more about the drug here.HIWU collected a hair sample from She Mysterious at Alburquerque Downs last December, which yielded an Albuterol detection. The presence of the drug was confirmed in a subsequent B sample. In its written final ruling, HIWU states that Chavez did not provide an explanation for the drug's presence by Jan. 14 as required.Nor did Chavez respond to HIWU by a Mar. 17 deadline to explain the legal remedy he wanted to pursue, HIWU writes.“HIWU attempted to contact Mr. Chavez multiple times in an effort to solicit his election with respect to these charges or be defaulted.
