At the same time, evidence also shows police let the perpetrator walk minutes before the incident occurred.As WANE reported on Tuesday, 30-year-old Fort Wayne resident Martell Pickens was home on May 7 when someone reported a suspicious person in his neighborhood. The individual, later identified as 25-year-old Khadolphee Taylor, was seen on video allegedly trying to break into various vehicles.Taylor then attempted to break into Pickens’s home. Pickens armed himself and went outside to confront Taylor.Pickens demanded to know what Taylor was doing and then told him to “back up.” But Taylor ignored Pickens and continued to advance toward him.Pickens then shot him once in the chest.When Fort Wayne police officers arrived on the scene, Taylor was bleeding from the gunshot wound.He was then rushed to a nearby hospital and was later pronounced dead.Court documents obtained by WANE show that Pickens not only admitted to the police that he shot and killed Taylor, but that he knew the man was unarmed and possibly intoxicated.The documents also say that Pickens gave police surveillance footage showing Taylor “wandering around the neighborhood for an extended period, attempting to open the screen door of the residence, walking away, and later returning.”As WANE notes, Indiana’s “stand your ground” law states that deadly force is justified when there is a reasonable belief that force is necessary for homeowners to defend themselves on their own property.But based on the alleged evidence, police determined the shooting was unjustified and arrested Pickens. He was charged with reckless homicide.“Based upon the investigation, Pickens knowingly armed himself and voluntarily exited the safety of his residence to confront Taylor,” a detective explained in the court documents. “During that confrontation, Pickens intentionally discharged a loaded firearm, striking Taylor in the chest and causing his death.”“Under these circumstances, there is probable cause to believe Pickens recklessly killed Khadolphee D. Taylor by engaging in conduct constituting a plain, conscious, and unjustifiable disregard of harm, the disregard involving a substantial deviation from acceptable standards of conduct,” the detective continued.Interestingly, the police could have avoided the incident altogether earlier in the evening.Roughly 20 minutes before the shooting, the police pulled over a vehicle that Taylor was driving. Officers believed that he was possibly either intoxicated or mentally impaired, and that his driver’s license had already been suspended.But instead of taking him into custody, the police towed Taylor’s vehicle and told him to walk home.Pickens was booked in the Allen County Jail on Monday.
