Matthew Caruana Galizia has said his family fully supports the prosecution’s appeal against the verdict which acquitted Yorgen Fenech of charges related to the murder of his mother, Daphne Caruana Galizia.His comments come after the Office of the Attorney General formally filed an appeal on Tuesday against Fenech’s acquittal, opening the possibility of a retrial if the appeal succeeds.“My family fully supports the appeal against this abomination of a verdict,” Caruana Galizia wrote in a social media post.“It is evil that must be retried. The alternative is a country where anyone can pay to blow you up, admit it on video, and get away with it all. Our institutions and the people in them must use all their might to end this madness,” he continued.Fenech was acquitted on 2nd September following a 55-day trial, with the nine-member jury returning an 8-1 not guilty verdict on both charges he faced: complicity in the wilful homicide of Daphne Caruana Galizia and criminal association.The prosecution had alleged that Fenech commissioned and financed the assassination through middleman Melvin Theuma. Fenech denied the charges against him.The Attorney General filed the appeal one day before the legal deadline, with the case now set to go before three judges in the Court of Criminal Appeal.The grounds available to the prosecution when appealing a jury acquittal are limited. The appeal does not itself overturn Fenech’s acquittal, but the Court of Criminal Appeal can order a retrial if the legal requirements are met.•
