The US Supreme Court on Friday evening once again blocked Missouri from using its new, GOP-favored map, staying a lower court’s order.The Missouri Supreme Court earlier this month threw out the state’s new congressional map that favored the GOP and eliminated one Democrat seat.The new map was set to only go into effect in 2028 if voters approve it during the 2026 midterms.Last year, the Missouri House of Representatives, controlled by Republicans, passed a sweeping new congressional map that would reduce Democrat representation to just one seat.A federal appeals court on Monday ordered Missouri to reinstate its GOP-favored Congressional map after the Supreme Court blocked the new map.The Eighth Circuit Court of Appeals said Missouri’s current plan to use the old map for this year’s midterms violates the Constitution.The three-judge panel included: Judges Loken (George H W Bush), David Stras (Trump) and Justin D Smith (Trump).“On November 3, 2026, Missourians will vote for federal and state candidates in this year’s general election. Spirited congressional and ballot measure campaigns have intersected in federal and state courts,” the court said.“The question presented to this Court is which congressional district map Missouri should use for the November 2026 elections: the map adopted in 2025 and used in the August 2026 primary election, or the map adopted in 2022. The people of Missouri deserve an answer to this important question,” the court said.“This Court holds that Missouri’s current plan to use the 2022 map in the November 2026 general election violates the Constitution. Only use of the 2025 map complies with the Constitution and federal law. We affirm the district court1 and remand for entry of a permanent injunction,” the court’s order read.The injunction was temporarily paused as the case headed back to the US Supreme Court for the third time.On Friday evening, the high court blocked the Eighth Circuit Court’s order. There was no dissent.The Supreme Court cited its previous concerns about changing the Congressional map after voting had already begun.“The election is not merely upcoming; it has already started. Ballots using the 2022 map have been printed and mailed. Absentee voting has already begun, as has military and overseas voting. According to local election officials in Missouri: “At this point, it is practically impossible to revert to the” 2025 “map,”” the order read.The Supreme Court admonished the appeals court panel for blaming the Missouri Supreme Court for its September 3 decision.“At this late date, ordering reversion to the 2025 map in the midst of an ongoing election would usher in electoral chaos. Purcell protects against such disorder. The Eighth Circuit panel dealt with Purcell by casting blame on the Missouri Supreme Court for its September 3 decision prohibiting use of the 2025 map. The state court, it reasoned, destabilized the election with its “last-minute decision” that could “potentially . . . decide the outcome of. . . party control of Congress,”” the Supreme Court said.
