I am pretty embarrassed to post this but I need realistic advice from someone who may know it better than I do. I am a pre-nursing student and currently work as a PCT in a critical care cardio hospital. I was recently charged with 3 Class A misdemeanors that are related to violence (assault on family, interference with a 911 call, and unlawful restraint). Every attorney that I have spoken to has said there is a high probability the case can be dismissed because during the time of the allegations I was trying to commit suicide. I was under the influence of a lot of medication that I took and fought a family member because they were actively trying to stop me from doing so. I understand that is not an excuse and I am 110% accountable for my actions and mistakes. Please don’t come at me in the comments because I understand how stupid it was and how it is most likely going to mess up my nursing career. My problem is, the attorney is very expensive and I found an affordable one because I am hesitant to go forward with a court appointed attorney, not because they are bad but I know they are very busy and I don’t believe that they will give my case the attention it needs to protect future licensing. I live in Texas; my mom who has been a nurse for 20+ years is very insistent that it would not mess up my nursing career but I do not want to invest the time nor money if I am ultimately going to be denied my license if I do get convicted. My mom says that nurses get DWIs (felonies in my state) and are still able to practice nursing, however, I believe DWIs are not violence related charges. I looked into the charges that the Texas BON would automatically deny your license and none of my charges are on there besides a felony unlawful restraint charges for which mine is a Class A. Additionally, the complaining witness did not want me to go to jail but wanted me to go to a hospital to receive treatment for which when I was under the influence I denied EMS not being in the right state of mind. The complaining witness also called the trail services to make sure we did not have a no contact order so I was able to remain living with them and they are going to be assisting with my case in any way they can considering it was more of a mental health crisis than a legal situation where they wanted me arrested. I guess my main questions are: What would you do if you are in this situation? and Do you know anyone who has been convicted of these or similar charges but were still able to obtain their license?
