Judge Edwina Grima has rejected the defence’s request to dissolve the jury in the Yorgen Fenech murder trial, allowing the proceedings to continue.The defence argued that the jurors had access to headlines containing information which had either been declared inadmissible or which should not have been referred to by witnesses or the press.Dr Charles Mercieca argued that the stage reached by the trial should not outweigh concerns over possible prejudice.“Just because the trial is at the stage it is and just because a lot of resources have been invested into this trial, doesn’t mean that we should keep going,” Mercieca said. “The prejudice is there.”The prosecution argued that the defence could have raised the matter earlier and that Martin Bajada’s report showed headlines that could have been accessed, rather than proving which headlines were actually viewed by jurors.It also argued that the headlines reflected events that had taken place in the courtroom and that the court must be satisfied there was potential for “irremediable prejudice” before dissolving a jury.The court has rejected the defence application, meaning the current jury remains in place and the trial can proceed.•
