Absa was fined over its unfair process in sacking former IT employee, Eddy MulemeThe Employment and Labour Relations Court has faulted Absa Bank Uganda Limited over the way it handled the dismissal of former IT employee Eddy Muleme, saying the bank had a valid reason to sack him but denied him a fair process.In a ruling dated July 21, 2026, Hon. Justice Anthony Wabwire Musana found that while Muleme removed electrical installations without express authorisation and acted outside his role during the bank’s Hannington Road to Kampala Road relocation, the disciplinary process was procedurally flawed because witness statements were withheld and his chosen representative was improperly restricted.The court said: “First, the respondent prejudiced the defence by suppressing prior witness statements, effectively blindfolding the Claimant and rendering effective cross-examination impossible. Second, the respondent violated Section 65AEA by misinterpreting the role of the Claimant’s chosen representative, actively gagging his lawyer during the process.Consequently, despite nominal compliance with notice and witness presence, these restrictive elements fundamentally undermined the Claimant’s statutory right to a fair hearing.” It added: “Consequently, we find that the Respondent possessed a valid, credible, and legally justified reason to end the employment relationship. The claim that the dismissal was substantively unfair is hereby rejected.”But in its final orders, the court declared the dismissal unlawful for procedural unfairness and awarded Muleme UGX 4,747,500 for four weeks’ pay, plus UGX 9,495,000 as two months’ pay in lieu of notice, bringing relief to the claimant despite Absa’s successful defence on the substance of the case. The post Court Slams Absa Bank’s Sacking Method, Orders Payout to Fired IT Officer appeared first on Business Focus.
