US District Judge Sharon Gleason, an Obama appointee, tossed out a lawsuit seeking to halt the Alaska Senate certification if incumbent Republican Dan Sullivan loses. The Justice Department previously sued to block Alaska’s Senate certification if incumbent GOP Senator Dan Sullivan loses over the Democrats’ dirty trick to use a ‘decoy’ Dan Sullivan on the ballot.Democrat operatives in Mary Peltola’s campaign worked to register a man named Daniel J. Sullivan as Dan S. Sullivan (the incumbent Senator’s name) as a Republican primary challenger.“The absence of any explanation from the United States as to how its requested relief could redress its alleged injury while simultaneously maintaining the secrecy of the ballot is telling,” Gleason wrote. “Simply, the Court cannot grant the United States the relief it seeks.”The lawsuit sought an order to block the Senate election results from being certified “if: (1) Senator Sullivan does not win the election; and (2) had all votes cast for Daniel J. Sullivan been cast instead for Senator Sullivan and Alaska’s rank-choice process played out accordingly, Senator Sullivan would have won the election.”“Given the substantial likelihood that the inclusion of Daniel J. Sullivan will confuse or mislead voters looking to cast a vote for Senator Sullivan, and thus distort the will of Alaskan voters, there is a substantial likelihood that a certification of the election will reflect an electoral process that lacked integrity,” the DOJ said in its complaint.Politico reported:A federal judge has thrown out the Trump administration’s lawsuit seeking to block certification of the Alaska Senate race if the Democratic candidate wins.U.S. District Judge Sharon Gleason ruled Sunday that the federal government can’t proceed with its suit claiming that voters could be confused between the incumbent Republican, Sen. Dan Sullivan, and a lesser-known candidate with the same name. The Obama-appointed judge concluded that the administration offered “no workable plan” to solve the purported problem it raised — potential confusion among voters about the presence of two Dan Sullivans on the ballot. Though the Justice Department asked the court to order Alaska to set aside ballots for an investigation, Gleason said there is simply no way such an investigation could be conducted in elections that depend on the secrecy of the ballot. The post JUST IN: Obama Judge Tosses DOJ’s Alaska Lawsuit Over Decoy Dan Sullivan appeared first on The Gateway Pundit.
