Bad Character Records boss Kalifah AgaNaga has taken on fast-food giant KFC, demanding Shs550 million over the alleged unauthorized use of his musical work in one of the company’s social media advertisements.Through his lawyers, Elgon Advocates, Kalifah has served KFC’s Managing Director with a notice of infringement of copyright and neighbouring rights over the use of his music from the ‘Nassanga Remix’ in a promotional video allegedly published on the company’s official TikTok account.According to the legal notice, KFC used Kalifah’s musical work as background audio in a commercial video without obtaining authorization from him or his representatives.The lawyers argue that the unauthorized reproduction and communication of the song to the public for commercial gain amounts to a direct infringement of their client’s copyright rights, entitling him to damages, an account of profits and an injunction under Section 46 of the Copyright and Neighbouring Rights Act.The notice further alleges infringement of Kalifah’s neighbouring rights, arguing that as the producer and performer of the work, his rights under Part IV of Cap 222 were violated through the unauthorized fixation and distribution of his performance for commercial purposes.Kalifah’s lawyers have demanded the immediate removal and deletion of the alleged infringing video from KFC’s TikTok account and all other official social media platforms where it may have been published.They have also demanded that the company immediately cease and desist from any further unauthorized use of Kalifah’s musical catalogue in its advertisements and promotional materials.On top of the removal of the content, they demand Shs500 million in aggravated damages, citing the alleged unauthorized commercial exploitation of his work, loss of potential licensing revenue and damage to his brand.The lawyers have further demanded Shs50 million in legal costs incurred while addressing the matter.KFC has reportedly been given seven days from receipt of the notice to comply with the demands.Failure to do so, the lawyers warn, will leave Kalifah with no option but to pursue formal legal proceedings against the company.The post Kalifah AgaNaga wants Shs550m from KFC over copyright infringement appeared first on MBU.
