Buc-ee’s has kicked off a legal battle against Beaver’s Mini Mart in Beavercreek, Ohio, claiming that the small store’s cartoon beaver logo is too similar to its own. This move then sparked a massive wave of frustration across the state and locals and social media users alike are calling out the Texas-based chain for what they see as an aggressive overreach against a local business. On TikTok, user brittybekkah recently shared how hate for the brand and pettiness from local businesses in response to the lawsuit is reaching an all-time high. “So being as petty as what the area I grew up in is like, all around the area of Beavercreek, um, everything is putting a beaver in their logo right now on their social media to show, like, Bucky’s. Like, bro, you literally messed up.” It’s easy to see why residents are so fired up. Beavers are essentially the mascot of Beavercreek, with the local high school and various other businesses using the animal in their own branding. As brittybekkah pointed out, “The last time I was in Beavercreek, I. Walmart had a beaver inside of it. Literally a painted beaver inside of it. I think the mall even had one in it. The Children’s Place has one out front.” David vs. Goliath According to FOX News, the lawsuit filed late last month argued that the Mini Mart’s use of a smiling cartoon beaver and red coloring mimics the famous Buc-ee’s brand. The company claims it has held federal trademark registrations for its logo for over four decades and argues that this branding could lead to “confusion among consumers.” However, the situation is a lot more complicated than a simple trademark dispute. The owner of the mini-mart, Vik Boparai, has operated the store for more than a decade, so before Buc-ee’s expanded into Ohio. One user noted, “Yeah after this I’ll NEVER go to the buccees after this.” Some users are even pointing out the irony of the situation. A TikToker wrote, “what’s ironic is the guy who started buccees stole the image and name from a cartoon.” This isn’t the first time the chain has faced scrutiny for its legal tactics. Per FOX News, comedian John Oliver recently used his show to highlight Buc-ee’s history of suing smaller companies with cartoon animal mascots. Oliver reportedly dared the chain to take on someone its own size. He even introduced his own mascot, Mr. Nutterbutter, to challenge them. “So, if any prominent gas station chain out there has an issue with our new logo and products and wants to get lawyers involved, then you know what? Bring it the f— on,” Oliver said on his show. For her part, brittybekkah clearly knows how she wants the case to go. In her post, she addresses the company, saying, “I hope whatever judge gets a hold of that case looks at you and laughs at you. And laughs you out of his courtroom straight up.” Then she addressed the lawsuit, claiming, “It’s petty. It’s just pettiness. It’s stupid.” The Hill reports that Buc-ee’s owner, Arch Aplin III, recently spoke with Huber Heights Mayor Jeff Gore to clarify his position. According to Gore, Aplin claimed that Buc-ee’s was concerned about the mini mart’s attempt to trademark “Beavermart” at a federal level. Gore reportedly stated, “Mr Aplin told me directly that Buc-ee’s had no issues with Beavermart using the Beaver logo in Beavercreek. He understood and said that makes sense. What Buc-ee’s did not want was a series of Beavermarts popping up across the state or regionally or eventually nationally that violated their trademark.” According to the Dayton Daily News, Boparai vehemently denied Aplin’s claim. He told the outlet that he only ever registered his store in Ohio on his bank’s instruction. Now, the community has reportedly rallied around the mini-mart remains strong, raising over $45,000 on a GoFundMe. Additionally, a “cash mob” event was held recently to support the store. Beavercreek Councilman Zach Upton told FOX that the lawsuit feels like a major overreach. “Common sense is not prevailing,” Upton said. “I can’t imagine anyone would be confused by the mini mart and Buc-ee’s. It’s not even in the same ballpark.” On TikTok, brittybekkah had a warning for Buc-ee’s. “They’re gonna hold you accountable,” she noted, “and you’ll be lucky if your store don’t go under.
