Every week, the TDN posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA)-related rulings from around the country.The following rulings were reported on HISA's “rulings” portal and through the Horseracing Integrity and Welfare Unit's (HIWU) “pending” and “resolved” cases portals.Among this week's rulings, trainer Robertino Diodoro was fined $500 after six of his horses tested positive for one or a combination of the following class C controlled drugs: Flunixin, Phenylbutazone or Triamcinolone.The six cases were post-race positives, all from Turf Paradise. They occurred between March 10 and March 30 this year. While each horse was disqualified and their purses forfeited, HIWU treated the six cases as one. The case was resolved without a hearing.When asked why HIWU treated the six cases as one, HIWU spokesperson Alexa Ravit pointed to guidance provided by HISA in September of 2023.As per this guidance, “if a trainer gets multiple positive tests for the same Controlled Medication, but the trainer is not notified of the first positive test before the occurrence of the other positives, HIWU has the discretion to treat all of the positive tests as one Controlled Medication Rule Violation–and, in fact, it is customary for HIWU to treat multiple positives together as a single violation when the positives occur prior to the first notice being received,” wrote Ravit.Additionally, in Diodoro's cases, many of his positive tests were the result of “stacking” violations.Combinations of nonsteroidal anti-inflammatories and and/or corticosteroids can constitute a violation, “even where the medications within the combinations are not detected above the applicable screening limit and would not constitute a violation on their own,” wrote Ravit.“The phenylbutazone, flunixin, and/or triamcinolone were found in all six horses, but they were not all present above the applicable screening levels in each horse to result in the medications being treated as separate violations,” Ravit wrote.“Based on the HISA guidance above and its treatment of similarly situated cases, as well as the additional circumstances of these cases and Diodoro's cooperation throughout the process, HIWU used its discretion to combine these positive tests to treat them as one Controlled Medication Rule Violation,” wrote Ravit.Resolved ADMC ViolationsDates: 07/27/2026Licensee: Benny Cadahia, trainerPenalty: Disqualification of Covered Horse's Race results, including forfeiture of all purses and other compensation, prizes, trophies, points, and rankings and repayment or surrender (as applicable); a fine of $500; imposition of 1.5 Penalty Points.
