Ahmedabad school student murder: FIR filed against principal for failing to report incident to police

The accused minor was sent to the remand home after being produced before the Juvenile Justice Board (JJB) on FridayFollowing the death of a student after being allegedly stabbed by a classmate in Ahmedabad on Tuesday, the principal of the school concerned has been booked for “failing to inform the police” about the incident, officers said.The FIR, filed by the Detection of Crime Branch (DCB) of Ahmedabad City Police on Friday, would be the third complaint in the case. While the first FIR pertained to the murder, the second one was lodged against a mob that allegedly vandalised the school on Wednesday – a day after the incident. Police said failing to inform the police about the stabbing was a cognizable offence.The accused minor was sent to the remand home after being produced before the Juvenile Justice Board (JJB) on Friday.During a press conference, ACP Bharat Patel of the Crime Branch said, “We have found that the school delayed informing the police regarding this incident. Based on a complaint filed in this matter by the father of the deceased minor, we have booked the school and its principal in a separate FIR under Bharatiya Nyaya Sanhita (BNS) sections 211 and 239. The only accused in this FIR is the principal, but if we find others who also failed to report it, legal action will be taken against them as well.”The BNS sections mentioned are applicable when a person in authority fails to report a cognizable offence that has occurred in their jurisdiction. The principal neither informed the police nor the district education officer, it was alleged.ACP Patel said, “The time of the crime is between 12.30 and 12.45 pm. But the police were told 50 minutes later, when information came due to the medico-legal case filed at hospital. We have questioned the school principal regarding the same and thus, we have found that there was negligence in this duty.”Addressing rumours of the victim not receiving timely medical attention, ACP Patel said, “After the victim was hurt, he walked back in through the third gate of the school and sat on a concrete parapet. When the watchman asked him what happened, the victim informed him of the incident. The watchman relayed this information to higher authorities, including the Vice Principal, and the child was taken to LG Hospital by the school clerical staff. The mother was informed immediately and the father was told later on.”Story continues below this adOn the incident itself, eyewitnesses and digital evidence, ACP Patel said, “The incident took place at the temple located near the school. The altercation was witnessed by other people present there. Student pick-up vans were also there.”On the motive and cause of death, the officer said, “The juvenile in conflict with law stabbed the victim on the left side of the stomach and the cause of death was bleeding. The two had arguments earlier, resulting in this tragedy.”ACP Patel said the police have determined that only one juvenile was involved in the incident. “There was only one juvenile accused at the time of the murder. The juvenile in conflict with law was produced before the JJB Friday and sent to remand home. The murder weapon (a foldable box cutter) has been recovered.”The Crime Branch has released another juvenile suspect who was detained for questioning.Story continues below this adEarlier, there was some confusion over the number of people present along with the accused during the stabbing due to lack of CCTV camera footage of the exact scene of crime. ACP Patel said, “All the school CCTV footage available has been collected.
