After her death, my father became the administrator and put their house on the market. We eventually found a buyer — our neighbor, who had known my father for many years. Over the years, this neighbor had expressed interest in purchasing the house whenever we were ready to sell.I later learned that I am one of the heirs and will be entitled to 18% of the sale proceeds. The house was reported as sold for $800,000, but I came across a letter from my father’s bank showing a wire transfer of $195,000 from the buyer, labeled “property purchase.” The money went into his account! Executors have a fiduciary duty to the heirs. That means they have a legal obligation to act in the best interest of the heirs, and not in their own best interest. They should act with care rather than recklessness and due diligence rather than impulsivity, avoid any conflict of interest, keep meticulous records of all financial and legal proceedings and keep the beneficiaries informed at all times. None of the above appears to have been done in this instance.Executors may also be held personally liable for failing to carry out their duties in a fair, honest and efficient manner. At a minimum, they should act in good faith and with honesty and integrity. In this case, your father should follow the instructions of the will or trust, assuming there were instructions, as you say. He should also seek the best market price for this house, which does not involve selling it to the nearest person at a privately agreed-upon sum, which could leave room for bribery. What’s more, your father should have put the money from the sale of this property into an account held in trust or an escrow account, and not into his personal bank account. The reason for this is simple. This is not his money! It belongs to your grandparents’ estate until it is dispersed to the heirs per the terms of the will or trust. Ask your father for detailed accounts related to the sale, and alert the attorney who was responsible for representing the estate in this transaction.Terms and Privacy PolicyPrivacy & Cookie SettingsMore InfoS&P 5006,466.91 +96.74 (+1.52%)Dow 3045,631.74 +846.24 (+1.89%)Nasdaq21,496.54 +396.22 (+1.88%)Russell 20002,361.95 +87.85 (+3.86%)VIX14.22 -2.38 (-14.34%)Gold3,418.50 +36.90 (+1.09%)PortfolioSign in to access your portfolioSign inTop gainersOPEN Opendoor Technologies Inc. 5.01 +1.41 (+39.17%)UI Ubiquiti Inc. 510.23 +119.66 (+30.64%)MNSO MINISO Group Holding Limited 26.63 +4.46 (+20.12%)RXO RXO, Inc. 16.97 +2.27 (+15.44%)NIO NIO Inc. 6.34 +0.80 (+14.44%)Top losersNEGG Newegg Commerce, Inc. 100.75 -15.03 (-12.98%)BJ BJ's Wholesale Club Holdings, Inc. 97.11 -9.05 (-8.52%)INTU Intuit Inc. 662.66 -35.10 (-5.03%)DUOL Duolingo, Inc. 331.87 -13.65 (-3.95%)CSX CSX Corporation 34.58 -1.29 (-3.60%)Most activeOPEN Opendoor Technologies Inc. 5.01 +1.41 (+39.17%)NIO NIO Inc. 6.34 +0.80 (+14.44%)INTC Intel Corporation 24.80 +1.30 (+5.53%)NVDA NVIDIA Corporation 177.99 +3.01 (+1.72%)LCID Lucid Group, Inc. 2.0300 -0.0600 (-2.87%)Earnings eventsTrending tickersINTC Intel Corporation 24.80 +1.30 (+5.53%)ETH-USD Ethereum USD 4,750.01 +438.60 (+10.17%)OPEN Opendoor Technologies Inc. 5.01 +1.41 (+39.17%)SOL-USD Solana USD 206.03 +22.32 (+12.15%)^GSPC S&P 500 6,466.91 +96.74 (+1.52%)Top economic eventsPowered by Money.com - Yahoo may earn commission from the links above.
