Attorney General Kiryowa Kiwanuka has formally written to courts of law and relevant government institutions, notifying them of a landmark ruling by the Constitutional Court of Uganda that declared the Computer Misuse (Amendment) Act 2022 null and void.In his communication, Kiwanuka directed that all ongoing cases arising from Sections 11, 23, 26, 27, 28, and 29 of the Computer Misuse Act 2023, as well as Section 162 of the Penal Code Act, which were affected by the court’s decision, be halted immediately. He further instructed that such cases be dismissed without delay.The Attorney General emphasized that no individual should be arrested or prosecuted under the nullified provisions going forward, effectively suspending their enforcement.However, he clarified that individuals who were previously convicted and are currently serving sentences under those provisions will continue to serve their penalties, as the ruling does not retrospectively overturn concluded cases.Constitutional Court declares Computer Misuse Act null and voidKiwanuka also noted that the government will not appeal the Constitutional Court’s decision.
