NAIROBI, Kenya Apr 25 – The National Police Service (NPS) has reaffirmed its constitutional mandate while urging members of the public to observe the law when participating in public meetings, demonstrations, and processions.In a statement, the Service emphasized that it is a national security organ established under Article 243 of the Constitution and operates within the framework of functions outlined in Article 244.The police service noted that while it remains committed to respecting human rights and fundamental freedoms as required under Article 244(c), these rights must be exercised in line with constitutional and legal provisions.NPS pointed out that Article 37 of the Constitution guarantees citizens the right to assemble, picket, and present petitions to public authorities, provided such activities are peaceful and unarmed.However, the Service stressed that these freedoms are not absolute. It cited Article 24, which allows for reasonable and justifiable limitations in the interest of public order, public safety, and the protection of the rights of others.The statement further referenced the Public Order Act Cap. 56(5), which outlines strict requirements for organising public gatherings. According to the law, public meetings or processions must be conducted between 6:00 a.m. and 6:00 p.m.Organisers are required to notify the relevant authorities at least three days before the planned event, but not more than fourteen days in advance. The notice must include full names and physical addresses of organisers, the date of the event, and details of the venue or procession route.The NPS also reminded organisers that they remain responsible for the conduct of participants during such events. They are expected to cooperate fully with law enforcement officers to ensure compliance with the law and maintenance of public order.In its advisory, the Service urged citizens to exercise their constitutional rights responsibly and within the boundaries of the law, noting that adherence to legal procedures is essential for maintaining peace and security during public gatherings.The police reaffirmed their commitment to protecting the public and upholding the rule of law while calling for cooperation from citizens in fulfilling their mandate.
