Every week, the TDN posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA) related rulings from around the country.The following rulings were reported on HISA's “rulings” portal and through the Horseracing Integrity and Welfare Unit's (HIWU) “pending” and “resolved” cases portals.Among this week's rulings, trainer Christopher R. Fung has been suspended two years and fined a total of $20,000 (including arbitration costs) after his trainee, Anointed King, tested positive for Clenbuterol after finishing second at Finger Lakes on Aug. 20, 2024. His suspension began on Apr. 25.The story dates back to the summer of 2023, when Fung acquired Anointed Spirit as an owner and trainer.During 2024, Anointed Spirit raced for Fung at Finger Lakes on June 25, July 23, Aug. 5, Aug. 20, Sept. 3, and Nov. 12. The horses tested negative after each of these races except for Aug. 5 (when he was not tested) and Aug. 20 (the sample in question).Though the bronchodilator Clenbuterol is classified by HISA as a banned substance, it is permitted for use for a maximum 30 days (within a six-month period) if accompanied with a valid veterinary prescription. Following administration, the horse in question is placed on the vets' list and is unable to work or race until it tests clear.In arguing his case, Fung questioned whether Clenbuterol was indeed in the horse's system due to a subsequent hair test that failed to confirm the findings of the urine sample, according to the final decision (delivered after arbitration hearings in September and December of last year).Fung also argued that he did not administer Clenbuterol to Anointed Spirit, did not “have any intent to commit or knowledge of committing any type of violation involving clenbuterol,” and contended it had probably been inadvertently transferred via the freelance groom, according to the final ruling.As part of his case analysis, arbitrator Bernard Taylor, Sr. noted how a governing rule “expressly prohibits negative results in hair from overriding” a positive urine finding, and that Fung has failed to make a persuasive case regarding inadvertent exposure.“The Arbitrator notes that there is no evidence that Trainer Fung intentionally administered a long-term therapeutic dosing regimen of clenbuterol to Anointed Spirit, particularly given the negative segmental hair analysis,” Taylor wrote.However, “the Arbitrator concludes only that Trainer Fung has failed to meet his burden of proving source by a balance of probabilities,” he added.Elsewhere, the HISA Authority has filed a notice of violation against Librado Barocio, warning the trainer faces a possible provisional suspension.This comes after HIWU investigators recently searched a vehicle registered to Barocio (parked in the owners and trainers parking lot at Santa Anita), finding five syringes capable of accepting hypodermic needles, two hypodermic needles, and six vials labelled polyglycan, four of which appear to have been used and were empty, according to the notice. Polyglycan is used to replace lost or damaged synovial fluid.The notice requires Barocio to submit a written response to the allegations. Barocio can also request a provisional hearing on the case, or else the Authority schedules the hearing instead.Stewards at Colonial Downs have also suspended owner-trainer Rodolfo Sanchez-Salomon for 30 days and fined him $2,500 after HIWU investigators searched his barn at the track and found fifteen syringes with affixed hypodermic needles inside the trainer's vehicle, according to the ruling.Sanchez-Salomon's suspension began on Apr. 27.
