Karnataka HC directs registration of FIR against Sandur police inspector for assault

The High Court of Karnataka has ordered registration of a First Information Report (FIR) against Mahesh Gowda, Police Inspector (PI), Sandur police station in Ballari district, on the complaint of assault lodged by a 25-year-old youth in August.Justice M. Nagaprasanna issued the direction while allowing a petition filed by V. Vivekananda, a resident of Kolur village, Kurugod taluk of Ballari district.The petitioner complained that he was assaulted by the inspector, but his complaint against him was not registered at the Sandur police station even though it was a cognisable offence.From pillar to postThe petitioner was made to run from pillar to post on his representation for registration of complaint against the inspector, and his representation in this regard to the Home Minister too has not yielded any result due to which he knocked the doors of the court.Pointing out that complaint cannot be declined to be registered when a citizen approaches police station of the jurisdiction alleging commission of cognisable offence by any person, even if it is a police officer, the court said registration of a crime against the accused for commission of a cognisable offence will not depend upon who the accused is.Stating that the FIR should have been registered by the police as complaint is indicative of cognisable offence of assault, the court directed the Superintendent of Police, Ballari, to ensure registration of FIR and fair investigation, if required through other police station.Published - November 18, 2025 09:30 pm IST
