‘Conduct not befitting of his post’: Gujarat HC grants bail to AAP MLA, prohibits entry in Dediapada taluka for one year

(file photo)The applicant is “a sitting MLA of Dediapada but his conduct is not befitting of his post”, the Gujarat High Court remarked orally on Monday while granting bail to Aam Aadmi Party (AAP) MLA and party’s Gujarat working president, Chaitar Vasava.Vasava, who has been accused of assaulting a BJP leader during a meeting at the Prant Office in Dediapada on July 5, was granted bail on the condition that he won’t enter Dediapada taluka for a year .Justice MR Mengdey heard the submissions of Chaitar’s advocate, Zubin Bharda, as well as the objections raised by the public prosecutor to the fresh bail plea moved by the MLA, following the filing of the chargesheet in the case.In an oral order on Monday, the Gujarat HC said, “The applicant (Chaitar) is a sitting MLA of Dediapada but his conduct is not befitting of his post… The incident had actually taken place and the applicant had assaulted the complainant… He is alleged to have assaulted the elected member of the taluka panchayat with a mobile phone and then hurled a glass at the complainant… His application is fit for consideration but he shall not enter Dediapada taluka for a period of one year, (except for) attending court hearings…”The MLA’s lawyer told the court that the initial police statement of the complainant, BJP leader Sanjay Vasava, was ‘different’ from the statement recorded during the course of the incident. Bharda also submitted before the HC that the complainant had sought medical treatment on July 8, three days after the alleged incident where Chaitar is alleged to have hurled a glass at the complainant. Bharda submitted to the HC that the quarrel between Chaitar and Sanjay Vasava over the “list of members” and the initial police statements had referred to the incident as a “mutual conflict”.Bharda argued that a “minor scuffle is being given the colour of an offence of (attempt to murder)”, pointing out that no one had sustained serious injuries and that Chaitar, too, had gone to the police station to report the incident and lodge his side of the complaint.Bharda also pointed out that while the police had recovered Chaitar’s mobile phone “with no damage” after it was allegedly hurled at the BJP leader, the police were unable to procure the CCTV recordings of the incident. Opposing the bail plea, the public prosecutor stated that the incident that has been reported “cannot be denied” and that the chargesheet had been filed by the Narmada district police “within 60 days”. The prosecution also submitted to the court that if Chaitar’s application is to be considered, it should be done “with certain conditions”.Story continues below this adAfter hearing both sides, the HC granted the bail to the MLA on the surety of Rs 10,000 and banned him from entering Dediapada taluka — one of the two talukas under his Assembly constituency — for one year. Chaitar’s home in Bogaj also comes under Dediapada Taluka.Close aides of the MLA told The Indian Express on Monday that he will now find a place of residence in Rajpipla, the head town of the district, as he will continue to work remotely for the restricted part of his constituency while visiting the rest of the area.Turning down the plea from Chaitar’s counsel to consider that the condition meant that as an elected representative, he will be “unable to participate in the meetings” of his constituency and that he was willing to submit an undertaking for “the best of behaviour”, Justice Mengdey orally remarked, “Look at your conduct and the style of your (politics)… Similar undertaking was given in an earlier offence..”The fresh bail plea was filed by Chaitar before the HC after withdrawing his previous bail plea, filed before the police submitted the chargesheet. Earlier in September, the Narmada Sessions court had granted three-day temporary bail to allow Chaitar to attend the Monsoon Session of the Gujarat Assembly from September 8 to 10, under police escort. The condition was then modified by the Gujarat HC based on Chaitar’s plea that he was “not in the position to bear the exorbitant cost of police escort” and his undertaking that he would “stay in Gandhinagar and not enter the district of Narmada, not address the media or make any statements before the media… also not conduct any gathering”.Story continues below this adOn July 5, BJP leader and Dediapada taluka panchayat president Sanjay Vasava had lodged a complaint against Vasava at Dediapada police station alleging that he had first abused Sagbara taluka panchayat president and BJP leader, Champa Vasava and later allegedly hurled his mobile phone and a glass at Sanjay Vasava while he tried to stop him from attacking Champa.
