(Express File)Madhya Pradesh High court wondered why FIR wasn’t registered over the alleged death of newborns in a rodent attack at Indore’s Maharaja Yeshwantrao (MY) Hospital.A Bench of Justices Vivek Rusia and Binod Kumar, which had taken “suo motu cognizance” of the deaths of two newborns at the Indore hospital, asked the state government to file a reply “explaining why an FIR has not been registered in the case of the death of two infants in the ICU of the Maharaja Yeshwantrao Hospital, Indore”.In a significant directive aimed at addressing the underlying infrastructure issues, the court ordered the Public Works Department to provide comprehensive information on multiple aspects of the hospital infrastructure. The court specified five key areas requiring detailed replies: “Condition of the building of Maharaja Yeshwant Rao Hospital, Indore / MGM (Mahatma Gandhi Memorial) Medical College, both internal and external. (ii) The life expectancy of the buildings. (iii) Condition of the drainage system. (iv) Condition of electrification. (v) How much budget would be required from the government for improvements?”Additionally, the court directed the department to prepare a DPR through its executive engineer or by engaging a consultant agency “for the renovation, repair and maintenance of the MGM Medical College building and hostel residential quarters, etc.”The court noted significant administrative changes at MGM Medical College – attached to the MY Hospital – after its administration told the court that the commissioner, revenue, “is no more In-Charge of the MGM Medical College”.The Commissioner, Health, is appointed as the In-Charge of the MGM Medical College… the disciplinary power has also been transferred to the Commissioner, Health,” the court said.The Dean of MGM Medical College and another respondent filed a detailed reply attempting to clarify the nature of the incident. The respondents argued that “the two infants did not die due to rat bites but due to multiple congenital malformations”. However, the hospital administration acknowledged systemic problems, with the court noting that “according to the respondents, the MGM Medical College is facing problems of shortage of staff, poor maintenance of the building by the Public Works Department, etc”.Story continues below this adIn response to the incident, the hospital has taken several corrective measures. The court recorded that “the contract for pest control given to HLL Infra Tech Services Limited (HITES) has been terminated” and “disciplinary action has been taken against nursing staff”.Earlier this month, the two newborns were admitted to the neonatal ICU with congenital anomalies (health complications existing since birth). After the rats bit their fingers, they were moved to another facility.
