By: Express News ServiceNew Delhi | Updated: September 27, 2025 01:28 AM IST 2 min readThe petitioner’s counsel argued that the transfer was necessary since the accused belongs to a family of lawyers and continues to serve as a judicial magistrate in Punjab.The Supreme Court on Friday issued notice on a plea seeking transfer of trial in a hit-and-run case, in which the accused is a judicial magistrate, from Punjab to Delhi.The family of the victim has expressed apprehension about getting a fair trial in the state, as the case involves a judicial officer from the same district in Punjab.According to the plea, the 32-year-old victim died in February this year after he was hit by a car allegedly driven by the magistrate. He was travelling from Hoshiarpur to Phagwara. The victim’s sister lodged a complaint but the family alleged that the police initially recorded the accused as an “unknown person” in the FIR. The family had moved the Supreme Court and, on its direction, the Punjab and Haryana High Court seeking a central agency probe in the case.A bench of Justices Surya Kant and Joymalya Bagchi on Friday asked the Punjab government to respond to the plea. The apex court also stayed the proceedings in the trial pending before a Phagwara court, and indicated that it would consider hearing the matter along with the writ petition being heard in the High Court. The bench asked whether the witnesses would be able to travel to Delhi for the hearings.
