If you’re not taking Donald Trump ignoring term limits and seeking to remain in power into 2028 and beyond, you’re going to be in for a nasty surprise in a few years. Trump and his cronies are constantly hinting that he’s going to remain in power, pushing their “Trump 2028” hats and teasing that this is what the people secretly want. Sensible conservative talking heads reassure us that the very idea of him seeking a third term is ridiculous. They say he’s obviously just kidding, or he’s playing to the base, or that you’re suffering from Trump Derangement Syndrome for listening to the words the president is saying. But you should take him very seriously indeed. During a visit to the Port of Corpus Christi on Feb. 27, Trump explained he’s “entitled” to that third term because he believes his rightful second term from 2020-2024 was stolen from him by Joe Biden: Trump: "Maybe we do one more term. Ughh.. one more… Well, we’re entitled to it because they cheated like hell in the second race.. we would actually be entitled to it.” How would this be possible? There is the tiny wrinkle that Trump is constitutionally forbidden from seeking a third term. The major hurdle is the 22nd Amendment, ratified by Congress in 1951 in direct response to FDR’s third and fourth terms. This states: “No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.” There is no emergency clause, no wartime provision, and no override mechanism, so Trump cannot simply say conditions in the United States are so dire that he must remain president. But a push is already underway to remove this pesky little amendment The Repeal22Now SuperPAC has been fundraising since April, with its goal that “presidents will be able to serve as many terms as the American voters want them to” and arguing: “Why should a Constitutional Amendment prevent another generation-shaping President like an FDR, if that is the choice the voters wish to make? Let’s work together to overturn a historic mistake, for our own sake and for the benefit of future generations. Repeal the 22nd Amendment!” A third term would still be an uphill battle for Trump, who may well be dead or incapacitated from old age by 2028 anyway. However, with his willingness to bend and break the rules, the complete submission of the Republican Party, and the general incompetence of the Democrats, we wouldn’t rule it out.
